This study considered hate crime data against those in the LGBTQIA+ community following the legalization of same-sex marriage in some states. The data on hate crimes used in the study was obtained from the National Incident Based Reporting System of the FBI’s Uniform Crime Reporting program, which collects data on criminal offenses committed against individuals and property. This database provides details on whether a criminal offense is motivated by the offender’s bias against the victim’s race, gender, religion, disability, sexual orientation, or gender identity. The authors note that only criminal offenses with sufficient evidence that the crimes are motivated by bias are reported as hate crimes and are included in the data (Nikolaou 2022).
According to the FBI website, law enforcement agencies representing about 49% of the population in the United States report data to the National Incident Based Reporting System. This database is one of the most complete and accessible crime-related databases (Strom and Smith 2017). It is the basis for many research studies that consider either the effect of crime on communities or the incidence of crime on social groups. It has been suggested that care should be used when attempting to study national trends based on the data (Maxfield 1999; Addington 2006; McCormack et al. 2017) because large urban areas are underrepresented in the database (Finkelhor and Ormrod 2000). Therefore, while the authors represent the results as a general summary of the trends in the United States, the actual population studied corresponds to the law enforcement jurisdictions that report to the National Incident Based Reporting System. This does not mean that the study is not useful, or that the results should be dismissed. For the evaluator of this research, it simply means that one should keep in mind that the data recorded in the database may not fully reflect what is going on in the United States as a whole.
