This research was based on an observational study as the authors of the study obviously did not control any of the factors that would influence the rate at which hate crimes were observed. The authors of the study pointed out several potential confounding problems. The main such problem was that societal views may be changing regardless of the implementation of same-sex marriage laws. For example, the authors pointed out that changes in population demographics, anti-hate crime legislation, and population migration may also influence the rate of hate crimes against the LGBTQIA+ community. Migration could possibly be in response to same-sex marriage legislation. The authors of the study attempted to address these issues using statistical techniques.
The impact of this study is difficult to assess as the social constructs associated with societal trends, acceptance, and violent crime are complicated. It is certainly believable that legislative or judicial progress in the marriage rights of the LGBTQIA+ community could have some positive influence on individuals who have moderate or slight bias against those in the LGBTQIA+ community. It may be more difficult to accept that those with very strong feelings, those who would act violently against another individual, would be changed significantly by these factors. Indeed, there is a secondary explanation that could be as plausible in that the court cases could coincide with or even follow changes in societal attitudes about the issue. This is partially evidenced by the fact that many states legalized same-sex marriage, and that this type of legislative effort usually reflects changing attitudes that are already present in society. Therefore, the legislation could be in response to changing social attitudes about the LGBTQIA+ community.
