Despite this trend, homophobic sentiments, which are often expressed as hate crimes, are still widespread and under-reported (Coffman et al. 2017). In fact, sexual orientation offenses are the third most reported type of hate crime in the United States, with verbal harassment and discriminatory practices ranking as the top two forms.
Recent research investigated whether advances in marriage equality have influenced criminal offenses against the LGBTQIA+ community. The psychological theory known as the legitimacy model states that policies that legitimatize the LGBTQIA+ community can lead to increased acceptance and improved inclusion in the society (Flores and Barclay 2016; Black et al. 2007). One study revealed increased support for the LGBTQIA+ community among participants exposed to favorable reports of the U.S. Supreme Court deliberations about same-sex marriage compared to participants exposed to unfavorable reports (Tankard and Paluck 2017). Other studies have also indicated that the implementation of same-sex marriage laws have improved the general attitude toward the LGBTQIA+ community (Flores and Barclay 2016; Hooghe and Meeusen 2013; Kreitzer et al. 2014). The hypothesis is then that same-sex marriage laws can result in changes in social attitudes and individual behaviors that may reduce victimization of the LGBTQIA+ community.
These differences are studied using the scientific method through the variation in the implementation of same-sex marriage laws prior to the Supreme Court ruling that legalized same-sex marriage in the United States. Data for hate crimes against the LGBTQIA+ community were studied using data provided by the Federal Bureau of Investigation through the National Incident Based Reporting System. The data show that enacting same-sex marriage laws are associated with a 12% decrease in hate crimes (Nikolaou 2022). This supports the hypothesis that marriage equality increases tolerance and acceptance and decreases social stigma, both of which can lead to lower rates of hate crimes.
